This agreement contains the entire understanding between Holly Hicks Photography, LLC and the client (named above). The only way to change or add to the agreement is to do so in writing. It is understood that Holly Hicks Photography, LLC is the exclusive official photographer hired to perform the photographic services requested on this Contract.

Client is responsible for their own safety and actions and the safety and actions of their minor children while at the location of the photography session. Photographer is not responsible for any liability, accidents, illnesses, damage or loss to person or property that may result from the photography session itself or anything related to the photography session.

Client is responsible for making and including photographer in all plans and covering all costs associated with the session, including admission fees to theme parks and attractions and meals for sessions lasting more than 6 hours in length.

If anyone should fall ill, contact the Photographer as soon as possible to reschedule the session. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the ability to create images meeting the artistic standards of the Photographer, Photographer may elect to reschedule the session for an alternate day. If rescheduling is infeasible, Photographer will return the session fee, minus the deposit, and the deposit may be transferred to a future vacation date.

If Holly Hicks Photography, LLC cannot perform this contract due to fire or other casualty, strike, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return the session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged. In the event that Holly Hicks Photography, LLC fails to perform for any other reason, the photographer shall not be liable for any amount in excess of all monies paid.

Images from this session are selected and edited at the Photographer's discretion. The Photographer reserves the right to edit and release only those images deemed creditable as professional in quality and within the Photographer’s artistic vision. The session fee covers the time and talent of the Photographer, communication, editing of images, as determined by the photographer, and a short slideshow highlighting the photographer's favorite images from the session. The slideshow and a digital gallery of images (with watermark) will be made available to the client to view within 28 days of the session date. The digital gallery will be available to the client to view for one week. At the end of which, the Photographer and Client will discuss products to be purchased. The session fee does not include print products or digital negatives, those will be available for purchase from the online gallery. If client chooses to purchase high resolution digital files, client is responsible for downloading and backing up all high resolution files within 28 days of the delivery date. Photographer may not be held responsible for client loss of image files or photographic prints.

NOTICE OF COPYRIGHT: It is ILLEGAL to copy, reproduce, or alter these photographs or videos elsewhere without Photographer’s written permission and violators of this Federal Law will be subject to its civil and criminal penalties. The included images may not be entered into contests, sold, altered, copied, scanned, or used commercially in any format, digital, printed or otherwise. The images may not be used in any form, other than private usage, without express written permission from the copyright owner, Holly Hicks. Holly Hicks Photography, LLC retains all publication and general reproduction rights for these images.

I ("client") hereby grant to Holly Hicks ("photographer") the irrevocable and unrestricted right to use and publish photographs of me and the people listed above, or photographs in which I or the people listed above may be included, for editorial, trade, advertising, commercial, publicity, illustration and any other lawful purpose and in any manner and medium; to alter the same without any restriction; and to copyright the same for photographer's sole and exclusive use and benefit. I hereby release Photographer from any and all claims and/or liability relating to said photographs.
